Lehi Car Accidents — Free Case Review

Car Accidents in Lehi, UT

Lehi Personal Injury Lawyers helps accident victims in Lehi, UT get a free case review from an experienced personal injury attorney for car accidents claims. Most Lehi crashes we hear about happen within a mile of an interchange rebuilt in the last few years. There is a reason for that.

UDOT finished the I-15 Technology Corridor project here in the fall of 2020: six lanes each way instead of four between Lehi Main Street and SR-92, seventeen bridges reconstructed, a crossing added at Triumph Boulevard, one-way frontage roads between SR-92 and 2100 North.

The SR-92 interchange was a diverging diamond for seven years before being rebuilt as a conventional one in 2019. People drive this geometry from memory, and memory is several configurations out of date.

Then the claim begins, and in Utah it begins on your own policy. This is a no-fault state, so personal injury protection pays first no matter who caused the collision.

The statutory minimum is small: medical benefits of at least three thousand dollars per person, wage loss at eighty-five percent of lost gross income subject to a weekly cap and a limited number of weeks, and a small daily allowance for household work somebody else now does.

One emergency room visit with a CT scan spends most of it.

The same figure runs the rule that matters more.

Under Utah Code 31A-22-309, a person covered by PIP may not claim general damages, the part of a case that is not receipts, unless the injury involves death, dismemberment, permanent disability or permanent impairment based upon objective findings, permanent disfigurement, a bone fracture, or medical expenses in excess of three thousand dollars.

The threshold and the minimum PIP bucket are the same number, so the week minimum PIP runs out tends to be the week the claim changes shape. The threshold also does not apply to an uninsured motorist claim.

Every item on that list is a document. A fracture is a radiology finding. Permanent impairment based upon objective findings is a phrase a physician either writes in a chart or leaves out.

Three thousand dollars in medical expense is an arithmetic question about which bills were submitted, to whom, and when. PIP has to be claimed rather than assumed, the carrier wants an application, and providers have to know where to send charges.

When imaging goes to a health plan instead of PIP, or a clinic sits on a bill for two months, the ledger that decides the threshold reads smaller than the injury.

The first weeks of dates do more work than anything said later. A Friday crash and a first appointment three weeks out produce a page identical to someone who felt better and quit going, because nobody writes next available opening into a payment log.

Care here splits across an urgent care near Thanksgiving Point, a clinic, imaging in a third building and therapy in a fourth, so nobody holds the whole chart, and the PIP ledger ends up the only continuous dated record in it.

The other insurer runs its own sequence meanwhile: a recorded statement requested while soreness is still described casually, an authorization broad enough to reach years of unrelated history, then an early number that arrives because the file is thin. Describing the pattern is not advice about it.

Fault gets apportioned under Utah Code 78B-5-818, modified comparative fault with the cutoff at half. A share of blame reduces a recovery by that share, and a person whose own fault reaches fifty percent recovers nothing. On a merge or a frontage road entrance where two drivers each have a lane assignment to explain, those percentages are the whole argument.

Who wrote the report decides where you ask for it. Lehi Police, at 128 North 100 East on a Monday-through-Thursday schedule, covers city streets.

The Utah Highway Patrol works I-15 and the state routes through town, SR-92 and the Lehi segment of SR-73 among them, and the county sheriff covers the unincorporated gaps.

Lehi releases crash reports through an online vendor and handles other records by GRAMA request, under Utah's public records act, while the Highway Patrol runs its own portal.

Transit changes the clock entirely. The Lehi FrontRunner station sits on Ashton Boulevard inside Thanksgiving Point, reached from the SR-92 interchange, with UTA buses including the Tech Corridor connector feeding it.

The Utah Transit Authority is a governmental entity, so a claim involving one of its vehicles runs under the Governmental Immunity Act of Utah: written notice of claim within one year of when the claim arises, then sixty days for the entity or its insurer to approve or deny, and the time to sue runs off that.

People lose that deadline while still in therapy.

One more question is worth asking out loud. Were you working when it happened?

The office parks along Triumph and Ashton generate a lot of midday driving, and a crash on the clock can open a workers' compensation file beside the injury claim, with the compensation insurer generally expecting repayment out of anything recovered from the driver.

A suit, if one is filed, normally goes to the Fourth District Court, which covers Utah County along with Juab, Millard and Wasatch, at the Provo courthouse on Freedom Boulevard.

Plenty of Lehi collisions need no attorney at all. If you were nudged at the 2100 North light, saw nobody, missed no work and the bills never came near the threshold, there is no general damages claim to bring.

PIP and the property damage side finish it, and handing a third of that to anybody would be a loss.

It is a different file once an ambulance came, once a scan or a fracture is in the record, once PIP is spent and bills route to a health plan that wants reimbursement, or once a commercial truck or public vehicle is involved.

How a car accidents claim actually gets paid in Utah

Almost nothing about a car accidents claim happens in a courtroom. An attorney opens the claim with the insurer, locks down evidence before it disappears — personal injury protection benefits, police crash report, emergency room records — and then waits for you to finish treatment, because the value of the case is not knowable until a doctor says where you have landed.

Once treatment is complete, the firm assembles a demand package: medical records and bills, wage documentation, the incident report, photographs, and where the injury is serious, opinions from treating physicians or a life-care planner. The insurer answers low. Negotiation follows. If the number stays unreasonable, the firm files suit, and a large share of cases settle in the months after filing rather than at trial.

You pay nothing while any of that is happening. The fee is a percentage of the recovery, agreed in writing at the start, and it is zero if there is no recovery.

Where our safety figures come from

We are not a law firm, and nothing here is legal advice. The crash and injury context on this site comes from independent research bodies rather than from us: Insurance Institute for Highway Safety publishes the crash-test and injury research the industry runs on, and AAA Foundation for Traffic Safety runs independent crash-causation studies. Ask any attorney you speak with how those findings apply to your own case.

Before You Book Car Accidents

How much does a Lehi car accident lawyer cost?

Nothing up front. Personal injury attorneys in Utah work on contingency, which means the fee comes out of the settlement or verdict and there is no fee at all if they do not recover money for you. The case review Lehi Personal Injury Lawyers sets up is free as well, and you are never obligated to hire the attorney you speak with.

How long do I have to file a car accidents claim in Utah?

Every state puts a hard deadline on injury claims — the statute of limitations — and once it passes, even a strong car accidents case is usually finished. Claims against a city, county, transit authority or state agency can carry a far shorter notice window, sometimes only a few months. That is the real reason to start early: an attorney can confirm the exact deadline that applies to your Lehi claim while you still have time to use it.

What is a car accidents case worth?

It turns on the medical bills already paid, the treatment still ahead, wages and earning capacity lost, property damage, and how much the injury changed ordinary life. Fault matters too, because Utah reduces or blocks recovery when the injured person shares blame for what happened. Any lawyer who quotes you a number before reading the medical records and the crash or incident report is guessing.

What should I do right after a car accident in Lehi?

See a doctor even if you feel fine. Adrenaline masks soft-tissue and head injuries for a day or two, and a gap in treatment is the first thing an insurance adjuster attacks. Photograph the scene, the vehicles or hazard, and your injuries. Collect names and phone numbers for witnesses before they leave. Report it in writing. Then say as little as possible to the other side's adjuster until you have talked to a lawyer.

Will my car accidents case have to go to trial?

Most do not. The large majority of injury claims settle once treatment is complete and the demand package is in front of the insurer. Filing suit is often simply the step that makes a low offer move. An attorney with a record of actually trying cases tends to pull better settlement numbers than one who never files.
